PAHRUMP TOWN ORDINANCE NO. 59

UNDOCUMENTED FOREIGN NATIONAL

REGISTRATION ORDINANCE

WHEREAS, the Pahrump Town Board is charged with upholding the Constitution of the United States of America and the Constitution of the State of Nevada, County of Nye; and

WHEREAS, the Pahrump Town Board members are United States Citizens and uphold and protect the Law of the Land, and we are Patriots of this Great Town, State and Country; now

THEREFORE, the Pahrump Town Board of the unincorporated Town of Pahrump, Nye County, Nevada, does hereby ordain as follows:

1. REGISTRATION. All undocumented foreign nationals shall register at the Pahrump Town Office within 24 hours of arrival in the Town.

2. REGISTRATION FORM AND FEE. A registration form shall be provided to all undocumented foreign nationals for completion of the registration process. A fee of $200.00 shall be collected by the Town Of Pahrump at time of registration. All fees collected shall be utilized for purposes of administration and to defray any expenses incurred resulting from enforcement of the ordinance.

Registration Form for undocumented foreign nationals shall include the following:

  1. Full name and all alias’s the registrant has been known by in the past.
  2. Current address and all previous addresses in the State of Nevada.
  3. Names of all relatives currently residing in the State of Nevada.
  4. Current employment and all previous places of employment in the State of Nevada.
  5. A list of all forged or counterfeited documents currently in possession of the registrant
  6. An affirmation section that all statements in the registration form are true.
  7. One (1) current color passport size photograph of the registrant.
  8. One (1) full set of finger prints of both hands of the registrant.

3. PENALTIES.

Failure to Register

Failure to register within the 24 hour period shall be a violation of this ordinance which shall be punishable as follows:

1st offense: A five hundred dollar ($500.00) fine and 10 days incarceration in the Nye County Detention Center and 30 days community service. Any community service shall be prescribed by the Justice Of The Peace of Pahrump.

2nd offense: A five thousand dollar ($5,000.00) fine and 100 days incarceration in the Nye County Detention Center.

3rd offense: Deportation to Country of Origin. Funds for deportation shall be raised by the Town Of Pahrump from a fund established by registration fees and fines levied against undocumented foreign nationals.

Falsification

Any falsifications made by undocumented foreign national during the registration process shall be deemed an attempt to circumvent the undocumented foreign national registration ordinance and shall be punishable by a $500.00 fine.

4. CHALLENGE FEE. Any non-government agency that shall challenge this undocumented foreign national ordinance shall upon challenge pay a $ 20,000.00 fee to cover any costs which may be incurred by the Town of Pahrump. The fee shall be non-refundable and shall be used for any legal challenges that may be incurred by the Town of Pahrump by the challenging party or parties.

5. OTHER LAWS, CODES, ORDINANCES AND REGULATIONS. This PTO shall not be construed to prevent the enforcement of other laws, codes, ordinances, and regulations which prescribe standards other than are provided herein, and in the event of conflict, the most restrictive shall apply.

6. CONSTITUTIONALITY. If any section, clause, or phrase of this Ordinance shall be declared unconstitutional by a court of competent jurisdiction, the remaining provisions of this Ordinance shall continue in full force and effect.

7. REPEAL OF PRIOR OR CONFLICTING ORDINANCES. All ordinances, parts of ordinances, or chapters, sections, subsections or paragraphs or resolutions previously adopted by the Pahrump Town Board which are in conflict herewith are hereby repealed. Any previously enacted amendments to this Ordinance are hereby incorporated into the main body of this Ordinance.

8. SEVERABILITY. Every section of this Ordinance, and every part of each section hereof is hereby declared to be independent of each other and parts of sections, and the holding of any section or any part thereof to be voided or ineffective for any cause, shall not be deemed to affect, nor shall it affect, any other section or part of section contained in this Ordinance.

9. EFFECTIVE DATE. This Ordinance shall be in full force and effect from after its passage, adoption, and second publication in a newspaper printed and published within the Town of Pahrump, Nye County, State of Nevada.
